Terms of Service & End User License Agreement for Flying Bug Identifier — “Is It Dangerous? Bug ID”.

These Terms of Service, together with the End User License Agreement in Section 17 (collectively, the “Terms”), form a legally binding agreement between you (“you” or “User”) and [legal entity] (“Bulpara”, “we”, “us”, or “our”), the developer of the Flying Bug Identifier mobile application, distributed on the Apple App Store under the display name “Is It Dangerous? Bug ID”, together with its related website, backend services, and content (collectively, the “App” or “Service”).
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT SAFETY WARNINGS (SECTION 4), AN ASSUMPTION OF RISK (SECTION 4), A DISCLAIMER OF WARRANTIES (SECTION 8), AND A LIMITATION OF LIABILITY (SECTION 9) THAT LIMIT OUR RESPONSIBILITY AND AFFECT YOUR LEGAL RIGHTS.
1. Acceptance of these Terms
By downloading, installing, accessing, or using the App, or by tapping “I Agree”, “Continue”, or a similar control at first launch, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the App, and delete it from your device.
The App does not require an account, login, or sign-in; it is used anonymously. Your agreement to these Terms is therefore recorded by your acceptance at first launch and by your continued use of the App. If you are using the App on behalf of another person (for example, a member of your household), you are responsible for ensuring that person understands and follows the safety warnings in these Terms.
2. Safety acknowledgment (required at first launch)
Before you can use the App’s identification feature, you complete a brief safety-acknowledgment step during onboarding. That step is non-optional. By completing it, you acknowledge and agree that:
- The App is an educational identification aid only, and its results are AI-generated suggestions that can be wrong;
- An identification or risk verdict must never be used as the basis for handling, touching, or picking up an insect, or for any medical or pest-control decision — many benign-looking insects have dangerous look-alikes;
- A sting or bite can cause a severe allergic reaction, including life-threatening anaphylaxis, and a misidentification can lead to costly property damage;
- You will not handle an insect based on the App’s result, and will keep a safe distance from stinging insects and their nests; and
- If you or anyone else has a severe reaction after a sting or bite, you will seek emergency medical care immediately and will not wait for, or rely on, the App.
Your completion of the safety-acknowledgment step is a condition of your license to use the App. Re-affirmation may be required after major updates to these Terms or to the App’s safety guidance.
3. Description of the Service — what the App is and is not
What the App does. You photograph an insect (or other small arthropod, such as a spider or tick). The App uploads that photo to our backend, which submits it to a third-party artificial-intelligence vision model (see Section 12) that returns an educational risk assessment. A result may include: a risk class (one of Stinging, Biting, Disease-vector, Structural-pest, Benign, or Unknown), a possible species identification (common name, scientific name, order, and family) with a confidence level, sting/bite information, a disease-vector note (with tick-removal guidance for ticks), a structural-pest note including the flying-ant vs. termite-swarmer distinction where relevant, a list of look-alikes, general behavior and habitat information, a concrete next-step action, an anaphylaxis emergency block where a sting or allergy risk applies, and (for subscribers) a follow-up chat. The App does not use your location: it captures no GPS, no region, and no country, and it never requests location permission.
What the App is NOT. The App is a general-interest educational and informational tool. It is expressly not, and must not be relied on as, any of the following:
- a medical device, diagnostic tool, or source of medical advice, diagnosis, or treatment;
- an emergency service or a substitute for calling emergency services (such as 911 or your local emergency number);
- a pest-control, extermination, or property-inspection service, or a substitute for a licensed pest-control professional;
- professional, expert, entomological, veterinary, or scientific advice; or
- a tool that can confirm that any insect, area, or situation poses no danger.
No affiliation. Bulpara and the App are independent and are not affiliated with, endorsed by, or sponsored by any pest-control, wildlife, governmental, entomological, or medical authority, organization, or agency. References to such professionals or services (for example, “contact a licensed pest-control professional”) are general guidance, not a referral to or endorsement of any specific provider.
The App does not and cannot guarantee the accuracy, completeness, or reliability of any identification, risk class, look-alike list, or guidance it provides. Identifying an insect from a photograph is inherently uncertain; lighting, angle, image quality, life stage, regional variation, and species mimicry can all cause errors, including errors that change a risk verdict.
No affirmative all-clear. The App will never tell you that an insect poses no danger, is fine to touch, or can be handled or picked up. A result of Benign is not an all-clear: almost any insect can bite or provoke an allergic reaction, benign-looking species have dangerous look-alikes, and any identification may be wrong. Treat every insect as potentially able to sting or bite, and do not handle one with bare hands.
4. Safety warnings and assumption of risk
READ THIS SECTION CAREFULLY. IT DESCRIBES RISKS OF SERIOUS INJURY AND FINANCIAL LOSS.
4.1 The risk
Insects and other arthropods can cause painful stings and bites, serious allergic reactions, disease transmission, and property damage. A sting or bite can trigger anaphylaxis — a severe, potentially life-threatening allergic reaction that is a medical emergency — even in a person with no previously known allergy. Some insects transmit disease (for example, mosquitoes and ticks). And a misidentification can be costly: mistaking a termite swarmer for a benign-looking flying ant can mean an active, undetected infestation goes untreated and damages your home. The App uses artificial intelligence to estimate risk from a photograph, and it can be wrong — it may understate a hazard, misidentify a species, or miss a dangerous look-alike. Relying on the App instead of keeping your distance and seeking professional or emergency help can result in serious injury or financial loss. You acknowledge that this is a foreseeable risk of misusing the App or over-relying on its output.
4.2 Your safety commitments
You agree that, when using the App, you will:
- Never handle, touch, catch, restrain, provoke, or pick up an insect based on the App’s result. Photograph from a safe distance; use your camera’s zoom rather than stepping closer, and do not approach a stinging insect near its nest.
- Never use the App’s result — including a Benign result — to decide that an insect is fine to handle or to ignore, or to make any medical or pest-control decision.
- Treat any Unknown or low-confidence result, and any situation where the App is uncertain, as if the insect could sting or bite until confirmed by a qualified expert.
- For any suspected termite swarmer or structural pest, obtain an inspection from a licensed pest-control professional rather than relying on the App alone.
- In the event of a sting, bite, or severe reaction, act immediately as described in Section 4.3, without waiting for or relying on the App.
4.3 If someone is stung, bitten, or has a severe reaction
If a person develops any sign of a severe allergic reaction after a sting or bite — swelling of the throat, tongue, or lips, difficulty breathing, tightness in the chest, dizziness or fainting, a rapid or weak pulse, or widespread hives — treat it as a medical emergency and call your local emergency number (such as 911) immediately, and use an epinephrine auto-injector (EpiPen) if one is available. Do not wait to identify the insect, and do not “wait and see if it gets worse”; a severe reaction can occur even with no previously known allergy. In the United States, a poison-control center is also available at 1-800-222-1222 (US only; outside the United States, contact your local emergency or poison-control service). For a tick, remove it promptly with fine-tipped tweezers, gripping as close to the skin as possible and pulling straight out without crushing, twisting, or burning it, and see a clinician if a rash, fever, or aches develop in the following weeks. The App’s guidance is general educational information only and is not a treatment plan or a substitute for professional medical care.
4.4 Assumption of risk
To the maximum extent permitted by applicable law, you knowingly and voluntarily assume all risks arising from your use of the App and from any encounter with an insect or other arthropod, including the risk of a painful sting or bite, a severe allergic reaction or anaphylaxis, disease transmission, or property damage resulting from a misidentification, an inaccurate risk class, a missed look-alike, or any reliance on the App’s output. You agree that you use the App at your own risk and that you — not Bulpara — are solely responsible for your decisions and conduct around insects and for the safety of any person, child, or animal in your care, including any person with a known sting or bite allergy.
Nothing in this Section limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our own negligence where such liability cannot lawfully be excluded (see Section 9).
5. Eligibility and age rating
The App concerns a safety-adjacent subject (stings, bites, disease vectors, and emergency guidance) and is not directed to children. It is rated for users 12 years and older and is not designed or marketed as a “kid-safe” application, and nothing in it should be read as a guarantee of a child’s safety around insects. You must be old enough to form a binding contract in your jurisdiction (generally 18, or the age of majority where you live) to accept these Terms; if you are between 12 and the age of majority, you may use the App only with the involvement and consent of a parent or legal guardian who accepts these Terms on your behalf. Do not use the App if you are under 12. The App does not knowingly collect personal information from children; see the Privacy Policy.
6. License to use the App
Subject to your compliance with these Terms (including completion of the safety-acknowledgment step in Section 2), Bulpara grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on an Apple-branded device that you own or control, solely for your own personal, non-commercial use, and as permitted by the Apple App Store Usage Rules and the Apple EULA referenced in Section 17. All rights not expressly granted are reserved.
7. Acceptable use
You agree that you will not, and will not attempt to, and will not permit anyone else to:
- use the App in any way that risks the safety of yourself, any other person, or any animal, including handling or approaching an insect in reliance on the App;
- use the App for any medical, diagnostic, emergency-response, pest-control, professional, scientific, or commercial identification purpose, or hold the App out as capable of any such use;
- upload content that is unlawful, infringing, or that depicts or facilitates harm to people or animals, or that you do not have the right to upload;
- upload photographs that contain other people’s personal information, or any content unrelated to insect identification, in a manner that violates any person’s rights or applicable law;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law;
- interfere with, disrupt, overload, probe, or attempt to gain unauthorized access to the App, our backend, our API keys, or our third-party providers, or circumvent usage limits, the free-tier scan limit, rate limiting, authentication, or entitlement checks;
- use any automated means (bots, scrapers) to access the Service, or resell, redistribute, or provide the Service to third parties; or
- use the App in violation of any applicable law, regulation, or the terms of any third-party service referenced in Section 12.
We may suspend or terminate your access, and may limit or disable features, if we reasonably believe you have violated these Terms or are misusing the Service.
8. AI output; disclaimer of warranties
8.1 Nature of AI output
The App’s identifications, risk classes, confidence levels, sting/bite and disease-vector information, structural-pest and flying-ant-vs-termite guidance, look-alike lists, habitat and behavior information, emergency guidance, and follow-up chat responses are generated by an artificial-intelligence model and are provided for general educational and informational purposes only. AI output can be incomplete, inaccurate, outdated, or wrong, including confidently wrong, and can understate a hazard, misidentify a species, or miss a dangerous look-alike. We do not warrant or guarantee the accuracy, reliability, completeness, or fitness of any AI output, and you must independently verify any identification with a qualified professional before relying on it for any purpose. No AI output is, or should be treated as, an affirmative statement that any insect, area, or situation poses no danger.
8.2 “As is” disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. Bulpara, on behalf of itself and its suppliers and licensors, expressly disclaims all warranties and conditions, whether express, implied, or statutory, including any implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement, and any warranties arising from course of dealing or usage of trade. Without limiting the foregoing, Bulpara does not warrant that the App will meet your requirements, that any identification or risk class will be accurate, that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties or limitations on statutory consumer rights, so some of the above exclusions may not apply to you. In that case, any statutory warranties are limited to the minimum extent permitted by law, and nothing in these Terms affects consumer rights that cannot be waived.
9. Limitation of liability
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) In no event will Bulpara or its officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, property, or other intangible losses, arising out of or relating to your use of, or inability to use, the App or any output, whether based on warranty, contract, tort (including negligence), strict liability, product liability, or any other legal theory, and whether or not Bulpara has been advised of the possibility of such damages.
(b) Bulpara will not be liable for any injury, illness, damage, or loss arising from your decision to handle, approach, or otherwise interact with any insect, from any misidentification or inaccurate or incomplete output (including a termite-vs-flying-ant misidentification or an understated sting, bite, or disease risk), or from any reliance on the App instead of seeking professional pest-control or emergency medical care.
(c) The total aggregate liability of Bulpara arising out of or relating to these Terms or the App will not exceed the greater of (i) the total amount you paid to Bulpara (if any) for the App in the twelve (12) months before the event giving rise to the liability, or (ii) twenty U.S. dollars (US $20.00).
(d) Exceptions. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. This includes, where and to the extent applicable law so provides, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, and for any non-waivable statutory consumer rights. You acknowledge that a disclaimer or limitation cannot make a false statement true; accordingly, our safety warnings and product descriptions are written to be honest and conservative, and we do not, and do not intend to, misrepresent what the App can do.
Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you. The limitations in this Section apply even if a limited remedy fails of its essential purpose, and reflect an agreed allocation of risk that is a fundamental basis of the bargain between you and us.
10. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bulpara and its officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App; (b) your interaction with any insect or your reliance on any output of the App; (c) your violation of these Terms or of any applicable law or third-party right; or (d) content you upload. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us. This Section does not require you to indemnify us for our own gross negligence, willful misconduct, or fraud, or where such indemnification is prohibited by applicable law.
11. Ownership and license of content and AI output
Your content. You retain ownership of the photographs you upload (“User Content”). You represent that you have all rights necessary to upload your User Content and to grant the license below. You grant Bulpara and its processors a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, re-encode (including to strip EXIF metadata such as any embedded GPS coordinates), and process your User Content solely to provide the Service to you (including submitting it to the AI provider for inference and returning a result), and to handle retention and deletion as described in Section 13 and the Privacy Policy. We do not sell your User Content, and it is not used to train the AI provider’s models (inference only).
AI output. As between you and Bulpara, and subject to the rights of our AI provider and other third parties, Bulpara does not claim ownership of the text of the identification result generated for your photograph, and grants you a license to use that result for your own personal, non-commercial, informational purposes, subject to these Terms. AI output may be non-unique and similar output may be generated for other users; you may not represent AI output as a professional or expert identification. The App itself, its software, design, branding, and all underlying materials remain owned by Bulpara or its licensors (see Section 14).
12. Third-party services
The App relies on third-party services, and your use of the App is also subject to their terms and privacy practices:
- Apple — the App is distributed through the Apple App Store; billing, subscriptions, and refunds are handled by Apple (see Sections 15 and 17).
- Replicate — hosts and runs the third-party AI vision model (currently openai/gpt-5-mini) used to process your photograph for inference. The photograph is sent to Replicate for processing.
- OpenAI — provides the openai/gpt-5-mini model that Replicate runs to produce the identification and risk assessment. The model executes on Replicate’s infrastructure; your content is used for inference only and is not used to train the model.
- Cloudflare R2 — stores the uploaded photograph (see retention in Section 13).
Bulpara is not responsible for the acts, omissions, content, or policies of third-party services, and their inclusion does not imply endorsement. What data leaves your device, and how it is handled, is described in Section 13 and in the Privacy Policy.
13. Privacy, data, and deletion
The App is used anonymously; there is no account. When you request an identification, one thing leaves your device: the insect photograph (with EXIF metadata, including any embedded GPS coordinates, stripped before upload). The App captures and transmits no location, region, or country of any kind, and it does not request location permission. Your scan history is stored locally on your device (and optionally synced through your own iCloud key-value store).
Retention and deletion. Uploaded photographs are automatically deleted from storage after 30 days by a lifecycle rule. The result data is cached only transiently, in-process, to return your result and is not re-hosted. The App also provides “Delete All Data” in Settings, which purges your local history and requests server-side deletion of your uploaded photographs. Full details, including the App Privacy disclosures and your rights, are in the Privacy Policy, which is incorporated into these Terms by reference.
14. Intellectual property
The App, including its software, source code, user interface, design, text, graphics, logos, the “Flying Bug Identifier”, “Is It Dangerous?”, and “Bug ID” names and marks, and all related intellectual property, are owned by Bulpara or its licensors and are protected by intellectual-property and other laws. Except for the limited license granted in Section 6, these Terms do not transfer any right, title, or interest in the App to you. You may not use our names, logos, or marks without our prior written permission.
15. Subscriptions, free tier, and billing
15.1 Free tier
The App includes a free tier of three (3) lifetime identification scans. Core safety information — the risk class, the sting/bite information, the structural-pest and flying-ant-vs-termite call-out, the disease-vector flag, and the anaphylaxis emergency block — is never placed behind a paywall and is shown on free scans. Only convenience features (unlimited scans, follow-up chat, and full history) require a subscription. Failed scans do not count against your free scans.
15.2 Premium subscription
Premium is offered as an auto-renewing subscription through the Apple App Store:

Prices are shown in your local currency and may vary by region and be adjusted over time; the price and terms presented in the App at the time of purchase govern. Any price change to an existing subscription will be handled in accordance with Apple’s rules and applicable law, and material increases will be communicated as required.
15.3 Free trial
The 7-day free trial (where offered, on the annual plan) begins when your subscription starts. Unless you cancel at least 24 hours before the trial ends, the trial automatically converts to a paid annual subscription and you will be charged. If you purchase a subscription that includes a free trial, any unused portion of the trial is forfeited when the paid subscription begins. Free-trial availability may depend on Apple’s eligibility rules.
15.4 Auto-renewal, billing, and cancellation
Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews at the then-current price for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You manage and cancel your subscription through your Apple ID account settings, not through Bulpara: open the Settings app → your name → Subscriptions, or the App Store, select Flying Bug Identifier, and cancel. Cancellation takes effect at the end of the current billing period; you keep premium access until then. Deleting the App does not cancel your subscription.
15.5 Refunds
Purchases and subscriptions are processed by Apple, and refunds are handled by Apple in accordance with Apple’s policies and applicable law. Bulpara generally cannot process refunds directly. To request a refund, use Apple’s “Report a Problem” process (reportaproblem.apple.com). This does not affect any non-waivable statutory right of withdrawal or refund you may have under applicable consumer law.
16. Changes, suspension, and termination
Changes to the Service. We may modify, update, suspend, or discontinue the App or any feature at any time, including changing or replacing the AI model, provided that we will continue to present core safety information (risk class, sting/bite information, structural-pest and disease-vector notes, and the anaphylaxis emergency guidance) without a paywall while those features exist.
Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and provide notice within the App or on the website as appropriate, and — where the change materially affects safety guidance or your rights — we may require you to re-affirm your acceptance. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using and delete the App.
Termination. These Terms remain in effect while you use the App. We may suspend or terminate your license and access if you violate these Terms or misuse the Service, or as required by law. You may terminate at any time by ceasing all use and deleting the App (which does not by itself cancel a subscription — see Section 15.4). Sections that by their nature should survive termination — including Sections 3, 4, 8, 9, 10, 11, 14, and 18 — survive.
17. Apple App Store — EULA and additional terms
The software components of the App are licensed, not sold, to you. Your license is the Apple Licensed Application End User License Agreement (“Apple Standard EULA”, available at apple.com/legal/internet-services/itunes/dev/stdeula), as supplemented by these Terms. To the extent these Terms conflict with the Apple Standard EULA with respect to your use of the App on Apple devices, the Apple Standard EULA governs the licensing of the App, and these Terms otherwise govern. The following Apple-required terms apply:
- Acknowledgement. These Terms are between you and Bulpara only, and not with Apple. Bulpara, not Apple, is solely responsible for the App and its content.
- Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where enabled.
- Maintenance and support. Bulpara is solely responsible for providing any maintenance and support for the App, as specified in these Terms or as required by law. Apple has no obligation to furnish any maintenance or support for the App.
- Warranty. Bulpara is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are Bulpara’s sole responsibility.
- Product claims. Bulpara, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including: (a) product-liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation, including in connection with the App’s use of any AI or health-adjacent features.
- Intellectual property rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, Bulpara, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints, or claims regarding the App should be directed to [legal entity], [address — to be completed], support@flyingbugidentifier.bulpara.com.
- Third-party terms. You agree to comply with applicable third-party terms of agreement when using the App (for example, your wireless data-service agreement).
- Third-party beneficiary. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. Governing law; dispute resolution; general
Governing law. These Terms are governed by the laws of [jurisdiction], without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise.
Informal resolution. Before bringing any formal claim, you agree to first contact us at support@flyingbugidentifier.bulpara.com and attempt in good faith to resolve the dispute informally.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice.
Entire agreement. These Terms, together with the Privacy Policy and the Apple Standard EULA, constitute the entire agreement between you and Bulpara regarding the App and supersede any prior agreements on that subject.
